I guess someone has to step up to the plate and start some legal action against the site.I am not a lawyer but the "owner"of the copyrighted material would have to start the action.I guess maybe a email to some kind of regulatory office from South Carolina would jumpstart some inquirys.Also if posted on the web the "fed"might be involved.Meanwhile if no one does nothing she will be raking in the cash and will be able to hire a lawyer(if she hasn't already)to fend off any complaints.Are there any legal minds in the Tville community that can chime in?I am sure the "thief "is following these posts and threads as we type.I do love a good fight.

I just looked at her site and found the one of my Yukon Quest pictures there without permission or notification. It's the one Tatianna has on Tomatobase.

I'm going to make a complaint to the BBB in Myrtle Beach, SC and also to the South Carolina Attorney General's office. If I could find out who hosts her website, I'll ask for their help as well. Meanwhile, if any stolen pictures or other stolen intellectual property shows up on her Facebook page, she will be in violation of the rules there.

I guess that I don't like the predator side of her actions. If she had asked in the beginning, I might have said yes, but I just don't like a thief.

Below is first the picture from her website and second my original picture taken in my kitchen.

Edited: As of 1:49 PM, on October 21, 2012, those two complaints have been made. I will post any responses received from the authorities in South Carolina.

I dont have many photos posted to steal but I would never purchase from this person. First Amendment right.......uh, this is a private site, with rules that are legal and not discriminitory. I distrust folks who whine and threaten a lot, especially when they dont know what they are talking about. Penny should be selling Atomic Grow in her spare time.

I just sent this email to the web hosting folks.

A website you are hosting named "Pennystomatoes.com" is using pictures of tomatoes for its sales that have been stolen from legitimate websites. Specifically, on the "pennystomatoes.com" page that appears when selecting "Dwarf" tomatoes, the picture of "Yukon Quest" is my property and permission has not been given for it to be used other than with licensed sites with which I have a contract. I have NO such contract with that site, nor the owners of that site. I am also aware that most, if not all, of the other pictures that appear in this section are also there without the REAL owner's permission.

Repeated requests to Penny have been met with only indifference and inaction. We need your help to stop this criminal action. We are aware that using stolen intellectual property is a violation of the Liquid Web Terms of Service and feel this is a flagrant violation of those user requirements.

This subject has been discussed extensively at "Tomatoville.com". I'm sure that if you contact the Tomatoville administrator, that he will be able to discuss what he has seen to be the full extent of this "robbery".

Please help us. Those intellectual properties must be removed immediately, as any delay increases the devaluation of our property and increases the possibility of litigation..

I really hate to see this.
It bothers me that someone would blatantly rip off photos rename tomatoes and so forth to build a business.

It harms honest people because new growers don't know this is going on.

I have aready heard people not in the know say they have grown tomatoes that are remade names.

This really stinks to no end.

And it isn't just small time folks doing it either.

I really don't like the fact that she is renaming some of
the tomatoes. You can loose the history of the heirlooms
that way.

Using others photo's without permission is also very
unprofessional.

Yup the mountain cherry's Carolyn sent to us 2 years ago, Mountain Magic and there are others, i refuse to read her remarks or her website. This sentence is terrible! well adapted to any garden even Mountain regions???Next she might say they grow under the sea!!!! or seeds fell to her from the moon?
