Tomatoville® City Limits - Terms of Use
Tomatoville® Garden Forums were created as a place for people to meet online and share their common interests and knowledge in all things tomato and garden related. To maintain a peaceful, friendly atmosphere here we have a few general guidelines that members should familiarize themselves with.
Only one account per household is allowed, unless permission has been given prior to creating an additional account. IP numbers are tracked and reported on every account. Multiple accounts are not permitted and members who create multiple accounts will have all of their accounts revoked. You must also be at least 16 years of age to register an account with us. Underage registrations will be deleted without notice. You must have a valid e-mail account in your profile so that an administrator can reach you. If we cannot reach you by email, your membership may be revoked without notice. Personal attacks in public posts are not acceptable. This includes "baiting" or "flaming" for you Internet old-timers. You are entitled to post your opinion, so long as that opinion does not reflect poorly on another member. Remember that it's ok to disagree, as long as it's done in a civil manner. One of the downsides about posting in forums is that words can be a poor substitute for reflecting emotion or facial expressions. Sometimes what's meant to be said isn't reflected properly in the words used. Adding a "smilie" emoticon may help, but not always. Keep this is mind before you take offense at another members' post and, if you should post something and it doesn't look quite right, by all means go back and edit it. Keep your words soft and sweet, just in case you have to eat them. "Ranting" is prohibited. A rant is a post which is long-winded, redundant and filled with angry, non-constructive comments. A free exchange of ideas is essential to building a strong sense of community here at Tomatoville®, but rants are disruptive and incite flaming and trolling. Please post your thoughts in a concise, clear manner and avoid going off on rambling tangents. Posts with excessive profanity are not acceptable and may result in revocation of your Tomatoville® membership. Using partial masking (such as asterisks or punctuation marks) or intentional misspelling to bypass the profanity filter is prohibited and will result in the same action as if the actual word had been written in your post or private message. Avoid using "Text Speak" in the forums. "Text Speak" has been popularized by cell phone users to communicate with each other using trimmed, phonetic and shorted words. Text Speak example: Txt Spk hs bn pplrzd by clfon usrs to cmunc8 wt ech otr usng trmd & shr8d wrds. Avd usng Txt Spk n d frm as 8 wil only cr8 cnfsn. There are two subjects not permitted in any forum here: Politics and Religion. There are vast amounts of Internet sites dedicated to both these subjects. Tomatoville® is NOT one of them. 1. No AVATAR shall contain a drawing, photo or other image of a political figure or symbol. 2. No SIGNATURE LINE shall contain any political reference, comment, innuendo, linked image or statement. 3. No LINKED IMAGE shall contain anything that displays a political figure, comment, reference, innuendo or statement. Definition of POLITICAL as used within Tomatoville® terms of use: A) Words or images that denote, support, dispute, disparage or otherwise refer to a past or present duly-elected or lawfully appointed member or members of a legislative, judicial or executive branch of government or candidate thereof, both foreign and domestic. B) Words or images that denote, support, dispute, disparage or otherwise refer to a supporter(s) or proponent(s) of a party, cause, faction or idea of the aforementioned in section A. NOTICE TO COMPANIES: We do not accept commercial advertising solicitations. Tomatoville® Gardening Forums is a privately-owned entity, operated and funded at no cost to our members. We neither seek nor rely on advertising revenue for financial support, nor do we allow our forums to be used for promoting products or services Spamming of any forum with the intention of promoting a product, service, etc. will result in revocation of your Tomatoville® membership. Not-for-profit posts are an exception and must be cleared with the webmaster prior to posting. Posting sexually suggestive/explicit/graphic content, photos, images or URLs that link to the aforementioned will result in revocation of your Tomatoville® membership. Original material posted here is protected by U.S. copyright and may not be reproduced or reposted elsewhere without prior written consent of the administrator/owner. Your membership here WILL be revoked if you violate this rule and additionally you may face criminal prosecution for copyright infringement. By submitting any content to this web site, you hereby agree to grant Commerce Holdings, LLC a perpetual, worldwide, exclusive license to store, reproduce, prepare derivative works incorporating, electronically transmit, publicly display, market, sublicense and sell any submitted content uploaded by you. Commerce Holdings, LLC in the exercise of its discretion, may refrain from any or all of the foregoing without any liability to you. Occasionally, our members will post their personal photos and share them with other members. "Photo-shopping" (altering) or adding disrespectful/offensive comments and/or captions to another member's personal photos is prohibited. Do not post personal information about other members without their prior permission. (i.e. addresses, phone numbers, etc.) Respect their privacy. Private communications between the administrator or moderators and forum members are not to be made public on these forums or by any other venue. Discussing or referencing banned members or vendors is not permitted. If a member or vendor has been banned, there is a reason for it and whether you agree or not is of no consequence to the administrator. Tomatoville® is a privately owned website and we reserve the right to allow or deny members and vendors as we see fit, without public explanation. Recruiting our members to join other non-affiliated sites, whether it be via posting, private messaging or email is neither wanted nor tolerated and will result in permanent revocation of your membership. The signature field in your profile may not contain images. It is to be used solely as a closing salutation for your posts. If you participate in harassing, ridiculing or otherwise insulting/personally attacking members of Tomatoville® elsewhere, you will no longer be welcome here. Comments/questions/polls soliciting for, or otherwise about race or sexual orientation of our members are not allowed and your membership may be revoked without prior notice if you violate this rule. You remain solely responsible for the content of your posts and by submitting them here for public display, you agree to indemnify and hold harmless Commerce Holdings LLC, the administrators and/or their agents with respect to any claim based upon transmission of your information. Tomatoville® staff members have been vested full authority to enforce these guidelines. Should you find yourself receiving a PM (private message) from one of them, please take it seriously. They have the full support and backing of the administrators. These guidelines are subject to change at any time without prior notification. We reserve the right to edit or delete posts at our discretion without prior notice or public explanation. If any part of this agreement is held void or unenforceable, it shall not affect the validity of the balance of the agreement.
